Terms of Service

You must be at least 12 years old to use the Services. If you are between 12 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has agreed to these Terms on your behalf where required by law.

If you are under 12, you may not use the Services. We may suspend or terminate accounts that we believe belong to users under 12.

We offer a corporate website (product information, contact forms, downloads) and Topya, a social mini-game platform. Features may change over time. We do not guarantee uninterrupted or error-free operation. The Services are provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by law.

Some features require an account or device-based profile as described in Topya. You agree to provide accurate information where asked, keep credentials secure, and not share your account in a way that violates these Terms or compromises security.

You are responsible for activity under your account except where our systems are at fault. Notify us if you suspect unauthorized access.

You agree not to:

• violate any law or third-party rights;

• harass, abuse, threaten, or harm other users;

• cheat, exploit bugs, use unauthorized automation, or interfere with the Services or servers;

• attempt to scrape, reverse engineer, or bypass security or rate limits except as permitted by law;

• upload malware or distribute harmful content;

• impersonate others or misrepresent your affiliation;

• use the Services to send spam or unsolicited advertising outside features we expressly provide.

We may investigate violations and take action including warnings, suspension, termination, and legal steps.

You may submit or generate content through the Services (e.g. nicknames, messages, shared scores). You retain ownership of your content where applicable. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g. format), display, and distribute your content as needed to operate, promote, and improve the Services and to enforce our policies.

You represent that you have the rights to grant this license and that your content does not violate law or third-party rights. We may remove content or accounts at our discretion, especially for violations of these Terms or legal requirements.

The Services, including software, graphics, logos, text, and game selection (excluding your user content), are owned by the Company or its licensors and are protected by intellectual property laws. Except for the limited license to use the Services as offered, no rights are granted to you.

You may not copy, modify, distribute, sell, or lease our materials without permission, except as allowed by mandatory law or open-source licenses where stated.

The Services may link to third-party sites or services; we are not responsible for their content or practices. When you download Topya from Google Play, Apple App Store, or other stores, their terms and policies also apply to the distribution and payment aspects they control.

If you use in-app purchases, virtual currency, or ads, additional terms from us, the store, or partners may apply as disclosed in-product.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.

Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent allowed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE SIX (6) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD 50), IF YOU HAVE NOT PAID US ANYTHING.

Mandatory consumer rights in your country may not allow certain limitations; in that case, these limits apply only to the extent permitted.

To the extent permitted by law, you agree to indemnify and hold harmless the Company and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or third-party rights.

Governing law: These Terms are governed by the laws of the jurisdiction in which Amazing Interactive Limited is incorporated, without regard to conflict-of-law principles, except where mandatory local consumer laws of your country require otherwise.

Disputes: You agree that courts located in that jurisdiction (unless otherwise required by mandatory law) have non-exclusive jurisdiction over disputes relating to these Terms or the Services.

Changes: We may modify these Terms. We will post the updated Terms and update the "Last updated" date. Material changes may require additional notice where required by law. Continued use after the effective date may constitute acceptance.

Severability: If a provision is invalid, the remainder stays in effect.
